I will be literally drop-dead surprised if the prosecutors actually take this case and file actual criminal charges against these men.

Ah, the Japanese "Justice" system and its kangaroo courts.

On a country that still treats ALL foreigners as 2nd or 3rd class people, how can somebody expect TRUE Justice over a murdered Sri Lankan girl?

Humans wherever we are we display the most animalistic characteristics of cruelty, insensibility, stupidity, and blind arrogance that characterizes our species. Criminal or not, she was a human being in the utmost distress. Humans are immersed in these predicaments, to appeal for their understanding and compassion is like to try to fill a well with shovels of snow. Reading this article I feel ashamed that I am human, but I have a secret way out, never to return to this realm.

Remember it just a request the outcome can be really different, they can just choose not to indict.

It’s just only about a few basic rules you have to inform yourself when coming here. No guns, no illegal drugs or other big crimes and yes, you guess it, no visa overstay. Anything else is fine and excused. Even if you walk with toilet slippers on a tatami mat, you probably are somehow forgiven and excused as a knowing-nothing-at-all foreigner. But the other few and easy to understand rules above, I really recommend that everyone knows before entering and then abides. What is such difficult to understand and leading to massive problems or even death sometimes? I mean, who finds the way to here, is maybe a student, otherwise skilled or at least has intelligence , is well informed and gets available informations beforehand and also can find them here everywhere. It’s just impossible that such a case can occur under normal circumstances.

Cos death is such an expected and logical outcome of visa overstay, isn't it? Must be obvious to all, right?

People should consider how such a judicial system took shape in the post war era and why it continues today.

History teaches that people working in the organs of a State will rarely indict their own kind 'cos jailtime for the guilty is off the table while paying out substantial monetary compensation sets undesirable precedents.

Too fringing right!!! Name them, shame them, and lock them up for involuntary manslaughter!!!

I understand She was free to leave Japan anytime but chose to challenge the system and because she was already past the visa validity, she needed to stay in the premises of the authorities

But ending up dead was not supposed to happen

Turns out you were right. And the pattern of voting suggests the same.

The people in the immigration center who were responsible need to be prosecuted to the fullest extent of the law., and most certainly deserve to be indicted. The immigration system itself needs a complete overhaul and frankly, shuold be a bigger topic for the J-govt than transgender bathroom rights. I say that only because no one is dying from the latter.

The victim should not have overstayed her visa and simply left and returned on a new one.

Well, that ain't going to happen. Japan is a country where you aren't even a citizen with EQUAL RIGHTS under the law. Somehow, they'll justify it because they broke the law first. The value of a foreigner's life is much less than say....a Japanese kid licking a soya sauce bottle in a sushi shop. We are dealing with a government, that doesn't value us, cause you expected to go home when you retire. The institutions themselves may have some racial bias too. Consciously or unconsciously! Someone in the prosecution office probably sat there, and said, " shoganai" and if the individuals can't be charged, then the institution is guilty for the actions and inactions of its staff.

Some of my replies defending this woman and her family have been taken down. I think the mods are kinda going OTT. Whether we agree or disagree, we should be able to offer a rebuttal and criticize the Japanese authorities.

Anyway, respect to the family because it is families and sadly victims, that will bring change to Japan. Trying to hold someone responsible for their negligence, incompetence or even institutional racism. You can't take someone into custody and let them die. Especially when the patient has been complaining for a month. I do think though some of us are lucky to have white privilege here. I see quite a few people of colour dying in custody here. I may be wrong, but I do think it warrants some objective research.

In the first place, it is difficult to say that they are refugees when they come to Japan by plane.

Japan should not accept economic refugees and should only accept asylum applications from outside the country.

Detention of illegal immigrants naturally causes such incidents.

Instead of detaining them, even if the other government refuses to accept them, criminals who are not needed by Japan should be returned to their country of nationality.

In the current situation, it is not the people of Asian countries who are not at war that should be helped, but the Ukrainians who have lost their homes and families due to the war and have been driven out of their places to live.

No one should be held in immigration and die. What Japan should have done was deported her instead of locking her up. On the other hand she should have known there are rules just as she made a arrival date to arrive in Japan she should have also had a plan and exited on her departure date. Rules are rules, if society don't have rules that people have to live by things could be even uglier. When you visit another country you are a guest of that country and you have to obey the rules that everyone else is expected to obey. I have heard the old saying that rules are made to be broken but there is also a price you have to pay when you break a rule. Her price was being locked up for overstaying her demise had alot to do with what she did while inside. The conscious tells you when you do something wrong the heart is warm when you know you are doing right. Life is what you make it, your out come is based on how you fit in.

I am against all injustice like all of you here and i hope you don't take this the wrong way and in no way this justifies what happened but let's not forget that She was free to leave anytime, in fact, She was already being deported to begin with

It was a voluntary choice that She stayed to fight the decision.

I cannot imagine the pain and heartache you’re feeling to all friends and family members of her. I am praying for your peace and comfort. Hope Japan will not ever do this again!

Wishma arrived in Japan in 2017 as a student but was later taken into custody at a Nagoya Regional Immigration Services Bureau facility for overstaying her visa. 

Japan is not for overstay..

Japan is just for legals..

There are other countries..

You said it perfectly, how is this Japans fault?

Because she was detained, then denied medical treatment. When the state detains someone, they have an obligation to ensure that person gets medical care as necessary. The Japanese government didn't meet that obligation, and therefore this is the fault of the Japanese government, and their liability.

Just don't hold your breath on this one.

God's speed. But like many here, I don't believe for one second that ANY form of justice will come out of this.

What her family needs to do is name and shame Japan and its Justice system on the international stage.

This is hard to digest, video footage showed how this lady was left to die in pain while asking for help, and yet some including the prosecution think it's fine.

You are better than this Japan, do this lady justice and put an end to this shame.

It is a logical and expected outcome if you choose to play chicken with your own body in an attempt to force the authorities to give you an undeserved right to stay where she doesn't belong. There's nothing I've seen that suggests Wishma would have died if, for example, she just agreed to go back - which she actually was willing to do until a crappy NGO fed her ideas. And of course she wouldn't have died if she had only followed the law.

The deportees have to fund their own airfare.

Which is only correct, and it is clear Wishma's relatives can assemble the money for a plane ticket if they tried, given the current proceedings.

Why couldn't they get the visa guarantor pay for her plane ticket back to Sri Lanka? This seems like it should be the responsibility of the employer or school that guaranteed her visa to begin with.
