Florida would likely prevail in a Florida state court that is going to be more interested in protecting Florida laws than matters of constitutionality when it involves the US Constitution, but the will have, I believe, a very hard time prevailing in a Federal Court on a matter that involved the US Constitution and especially so when it involves fee speech.

Let us not forget in the minutiae of lawsuits and counter suits what this is really all about.
