Police in Tokyo said they have arrested a 65-year-old man on suspicion of sexually assaulting a woman in her 20s during an ascetic training session last year.
According to police, Katsuhiko Ono, whose occupation is unknown, is accused of sexually assaulting the woman at a hotel in Tokyo’s Chiyoda Ward last December, Kyodo News reported. Ono reportedly told her, “If you train with me and experience pain, then you’ll be happy on the outside,” and “I’m the only one who can do this because I’m connected to God.”
Police said that Ono goes by the spiritual name “Kazuhito Shinsho.” Acquaintances would introduce him to women experiencing personal problems. He allegedly sexually assaulted them by claiming, “You’ve accumulated bad energy.”
Police said Ono has denied the charge and quoted him as saying: “It wasn’t rape.”
Since his arrest this week, other women have come forward and filed criminal complaints against Ono, police said.

It seems like he has targeted fragile women. Even though it may seem strange to believe he managed to fool them but professional ‘cult leaders’ are not that simple, they have methods, they probe the soil before acting Im sure, they would target mentally weak only. Thats why no matter how strong I wish I could be in the place of these women to make him experience pain insideout and outside theres no really a chance for me to make them happy.

It obviously has nothing to do with stupidity or intelligence. Aum's members included scientists, lawyers, doctors, etc., often from prominent universities.
It isn't about being gullible but more about being susceptible and vulnerable.
These cults and individuals target certain people that they know will respond the way they want. It's all carefully thought out and planned. They know who to work on and they're not all women.

My dog, only last night I was watching a video on YT about a cult leader who actually claimed he was Dog and all his followers believed him. His crimes against these people were many fold and they suffered, but they did not care. And he too had many so- called intelligent professional people following him, doctors, lawyers, etc... Well, and I remember what one of my teachers at Uni saying, anyone can become a professional and pass exams at University but that does mean they are intelligent, it just means they can retain enough knowledge to pass an exam.

Question 1: What are the specific criteria in Japan use to identify if a sexual assault occurred?

My reasoning:
Persuasion comes in many forms. It can be threats, physical violence, lies, bribes, happiness, peer pressure, and etc. Only one of the five would be considered illegal in most countries around the world. Some maybe in only professional situations.
Based on the information that may have been deliberately withheld in this article, Katsuhiko just lied to get these women to have sex with him when they might have been emotionally vulnerable. The context did not involve any professional setting.
1) Lying to have sex with another person is usually not a crime. Immoral, yes. Illegal, no.
2) Also, regret which some of this women may have because they no longer trust or like Katsuhiko alone should not be enough to charge a person with a crime.
3) Other people have also felt pressured to do something that did not necessarily want to do in their personal and professional lives. People sometimes have sex with their partners when they may not really be in the mood. However, unless physical violence was apart of it or some other illegal act then it may just have been an immoral act. Because without the threat of physical violence or another illegal act, those people can always just leave or continue to say 'No.'
